Through their lawyers, Lukwago and Company Advocates, the two made their bail application against the background of them having been arrested and charged for inciting violence.
Besigye, Mukaku apply for bail in High Court, again
The four-time presidential candidate and leader of People’s Front for Transformation, Dr. Kiiza Besigye, and Democratic Party activist Samuel Lubega Mukaku have applied for bail in the Criminal Division of the High Court in Kampala.
The duo’s lawyers argue that the lower court unlawfully denied them bail on the basis of a track record of unprosecuted criminal cases previously opened against them by the state.
“The decision by the learned trial Magistrate denying bail based on the aforementioned reasons derogated the applicant’s right to a fair hearing, civil liberties, and the presumption of innocence,” reads the application in part.
Besigye and Mukaku, were last week arrested for protesting against the increasing commodity prices and the concomitant rising standards of living.
The two activists were later charged at Buganda Road Court with incitement of violence and granted bail, but were arrested again after getting involved in further civil disturbances.
They applied for bail but Buganda Road Court Grade One Magistrate Asuman Muhumuza threw out the application saying that there is no guarantee that the two shall not continue doing what they did to be re-arrested on the same charges or other related offenses.
Lukwago wants the High Court to grant his clients bail in view of it being their constitutional right and also they are not flight risks since they have permanent places of abode and shall abide by the conditions of the court.
Besigye and Mukaku are currently at Luzira prison where they were remanded until July 1.
