This incident began when a case was opened against Tumwine at Kazo police station by Paul Beigana, a court bailiff, claiming Tumwine obstructed a court order which directed Steven Rwanyabushozi to open an access road.
Police probes Gen Tumwine over obstructing a court order, releasing suspect
Police in Kazo are investigating Rtd Gen Elly Tumwine for allegedly blocking court bailiffs and police from implementing a court order. If the general is found guilty, he could face jail time for the obstruction of justice.
According to Beigana, the court order was given the greenlight by the Directorate of Police Legal Services in Kampala and the Regional Police Commander granting the the Kazo district police commander permission to witness its execution in Burunga subcounty.
Samson Kasasira, the Rwizi region police spokesperson, confirmed the incident saying the bailiff arrived on site with police officers from Kazo police station.
However, the group was quickly intercepted by military vehicles along the Kazo-Rwemikoma road at the junction branching off to Tumwine’s home. This interception by the military vehicles stopped the group from executing the court order.
Kasasira says the court order issues from a judgment by the Kazo chief magistrate made on November 21, 2021, in a civil case where Grace Kakirenga, the complainant, accused her son Steven Rwanyabushozi, the defendant, of blocking an access road to her home.
The court ruling tilted the scales of justice towards Kakirenga, thereby ordering Rwanyabushozi to unblock the access road.
The ruling also awarded costs of Shs 24 million to Kakirenga.
Rwanyabushozi, did not take this ruling lying down and thus defied court orders, even when he was issued with a warrant of arrest.
Beigana alleges that when they were intercepted by military vehicles, Tumwine himself materialised to order them to hand over the court order and other documents that included a warrant of arrest. After which, he ordered them to leave the area immediately.
Beigana says Tumwine also freed the arrested suspect, Rwanyabushozi.
Tumwine has not made any public utterance on this matter.
