The ruling was made following a petition filed by a group of youth challenging the levy, which has caused fuel shortage across the country.
The case is set to be heard on September 12, 2018.
This comes days after a court in Nairobi opposed to suspend the implementation of the 16-percent VAT in a petition filed by activist Okiya Omtatah.
