Mr. Miguna is expected to land in Kenya at 4 PM after he was deported to Canada under controversial circumstances.

In a phone conversation with Pulselive.co.ke, Mr. Kihalangwa hanged up the call with a blatant "I do not have anything for you" when probed on whether the Immigration office had complied with Kenya National Commission of Human Rights' (KNCHR) request to facilitate Miguna’s entry into the country.

In a letter sent to the Immigration Department, KNCHR had demanded the Government to provide Miguna with a passport, pay his air ticket from Canada to Kenya and facilitate his smooth return.

The Human Rights organization was quoting orders issued by High Court judge Justice Chacha Mwita, who in his ruling instructed the Government to allow Miguna back to Kenya in order to appear before the court.

However, in a reply to the Commission, Mr Kihalangwa stated that for Miguna to get a passport he must follow the laid down procedure.

"The Department cannot issue Mr. Miguna with a valid Kenyan passport as he has not made an application for the same. Moreover and without prejudice, we reiterate that Mr. Miguna has to regain his Kenyan citizenship before being issued with a Kenyan passport,” the reply letter seen by Pulselive.co.ke read.

Kihalangwa further noted that he does not have the authority to allow the Commission officials inside the Immigration and Customs Clearance Area upon Miguna's landing stating that the section is controlled by the Kenya Airports Authority.

Miguna announced his return to the country but has since not divulged any information as to whether he has boarded a flight back home or not.

A source at the KNCHR revealed that they were also not aware of Miguna's itinerary as he had not sent it.
