Court blocks Gen Tumukunde Over Eviction

Lt. Gen. Henry Tumukunde’s plans to attach the land which holds over 1,000 residents of Jomayi Housing Estate, Mpigi district, has been halted by a court order.

The residents can now breathe easy as the General plans his next move, this one having been temporarily thwarted. 

Gen. Tumukunde is battling with Jomayi Property Consultants managing director Mr. Joseph Yiga Magandazi over the 200- acre piece of land at Njagi-Ssabagabo, Mpigi district. 

Court documents show that in 2012, Jomayi bought 200 acres of land from Gen. Tumukunde at sh3.5b. Thereafter, it was agreed that Jomayi immediately occupy the land and cause its subdivision, sell it to his clients after completing payment. 

Mr. Magandazi says he first paid sh2.6b to Tumukunde, but the general declined to give him the land title.

As he pursued the attachment of the land, Gen. Tumukunde applied for a warrant of attachment, claiming he demanded sh1.1b from Mr. Magandazi. 

“I sold my land to Jomayi 10 years ago and have to be paid because I have the titles. The lawyers want to prolong the matter because it brings business to their table,” a furious Gen. Tumukunde said. 

However, Justice Stephen Mubiru of the Commercial Court stayed the execution, pending the hearing of the main application in which Mr. Magandazi is contesting the attachment. 

If Gen. Tumukunde had his way, court bailiffs would have evicted the residents last Friday in fulfillment of the warrant of attachment. 

Justice Mubiru, however, issued the directive on the same day, saying Jomayi and the residents would have suffered irreparable loss if the stay was not granted. 

The judge subsequently set February 8, 2022, as the date for the hearing of the matter. 

Lt Gen (Rtd) Henry Tumukunde is a politician and retired senior military officer of the Uganda People's Defence Forces (UPDF).

 He ran as an independent for president in the 2021 Uganda general election but lost to incumbent President Yoweri Museveni .
